House Passes SB 638 to Repeal Hidden Tax on Groceries and Gas Bill Heads Back to Senate for Final Action

OKLAHOMA CITY — Senate Bill 638, legislation to repeal Oklahoma’s outdated mandatory markup law, passed the Oklahoma House of Representatives on Tuesday (4/29) with overwhelming support. The bill eliminates a 1949-era government mandate that requires retailers to artificially inflate the price of essential goods like groceries and gasoline by at least six percent, regardless of market conditions. Supporters of the bill call the markup a “hidden tax” that unfairly burdens consumers, particularly seniors and those living on fixed incomes.


SB 638 bill now returns to the Senate for final approval of House amendments — the last step before it can be sent to the governor’s desk.


“We are deeply grateful to legislators in both chambers for getting this bill this far,” said Jim Randall, Chairman of the Oklahoma State Council on Aging and Adult Protective Services. “SB 638 represents real relief for seniors and families across Oklahoma. We urge the Senate to take swift final action and send this commonsense measure to the governor without delay.”
